The courts set any criminal case up for pre-trial hearing before it goes to trial. This allows the parties to try and resolve the case in a way that is agreeable to both the defendant and the court whenever is possible.  Pretrial detention is another part of pretrial process and is based on keeping a person who has been accused of a crime within holding until their trial is a common practice. This practice has been set in place to attempt to ensure public safety and to ensure thatindividuals appear in court for their initial hearing.
