Negotiated rulemaking is a consensus-based process that Congress amended to the APA in 1990, which is implemented by federal agencies in the rulemaking process. Through this process, the agency develops a proposed rule and creates a negotiating committee. This committee is usually composed of twenty-five people or less and is integrated by representatives that could be affected by the rule, the agency itself, and with a neutral facilitator. The factors that an agency must consider when determining whether to use negotiated rulemaking are; if the parties that will be affected by the rule are twenty-five or less if a balanced committee can be assembled and will satisfactorily represent the several interests and will negotiate in good faith to get to a consensus; if the issuance of the rule will not be delayed by the negotiation; if the agency has adequate resources to support the negotiating committee; and if the agency is willing to use a committee consensus as to the basis for the proposed rule.
