Lawyers at times, may find themselves in positions where they are a part of a law firm or association. Furthermore, a lawyer may be delegated authority when supervising other attorneys within the firm. The supervisory role does have governing principles that are detailed within the ABA Model Rule textbooks. One rule to be discussed is the rule concerning an attorney’s obligations when supervising other attorneys. Our textbook state that “a lawyer having direct supervisory authority over another lawyer shall make reasonable efforts to ensure that the other lawyer conforms to the Rules of Professional Conduct.” [1] Additionally, the supervisory lawyer is responsible for any violations the subordinate lawyer may undertake of these Rules. [2] For example, if a subordinate lawyer attempts to unknowingly tamper with a witness during an ongoing trial, while being supervised by another attorney, it is up to the supervising lawyer to interject to ensure the subordinate lawyer does not violate this specific rule.
