Annotated Bibliography Instructions

The Annotated Bibliography and the Research Paper are related assignments that require you to research and write a review of the existing literature and then develop the information from your sources into a research paper. Both your research of the literature and the paper will focus on the legal, social, ethical, and biblical aspects of professional malpractice in healthcare, including the role of recognition of error and apology in resolving malpractice claims.

 

In the Annotated Bibliography, you will identify and discuss at least 10 scholarly sources relevant to the topic, other than the Reading & Study materials and the Bible. At least 2 of the sources must relate to your particular area of practice in healthcare (physician, nurse, allied health professional [be specific], administration, etc.), and at least 2 of the sources must relate to biblical worldview considerations of the topic. You are not required to use all of these sources in your Research Paper, and you may use other sources not reported here. The Annotated Bibliography documents your background on this topic and provides a snapshot of your research and analysis for the paper through Module/Week 5.

Sources were arranged alphabetically by author and were chosen based on the background of the author, the merits of the publication and how well the subject matter was identified, researched and documented. By and large, the bulk of the research returned an overwhelmingly positive response to proper disclosure of medical errors, acceptance of responsibility by the physician, and the role of apology in preventing and resolving malpractice claims. I have been a registered nurse for almost 25 years and practicing in the specialty of pain management, which has an increasing incidence of malpractice claims, for the past 21 years. The physician appropriately requested further information on the patient’s history but did not have time to receive or review it therefore, the newborn suffered a subsequent injury. The article uses this scenario to identify and explore disclosure guidelines, which can vary by state, as well as the reasons for hospitals and physicians to be reluctant to participate in full disclosure when unanticipated outcomes occur. There is explanation of legislation related to the national medical malpractice crisis known as “I’m sorry” laws which encourages full disclosure of medical mistakes and assists to eliminate the fear felt by medical facilities and physicians that their admissions will be used as evidence against them in court. The “I’m sorry’ laws also vary by state but overall have been found to facilitate open communication, decrease malpractice costs, relieve anger and frustration on the part of the injured party, and encourage continuation of the patient-physician relationship in the wake of an unanticipated outcome. This article was useful as it covered several key aspects that contribute to each side of the malpractice playing field; the fear felt by the medical community and the reasons patients seek retribution.
