This assignment will discuss; the facts of the case, when was the case argued, which lawyers argued the case for each side, and why is the case significant with respect to the right to counsel and self-incrimination? This assignment will also briefly summarize the arguments of counsel regarding self-incrimination.  In March of 1963, Ernesto Miranda was arrested inside of his own home on charges of rape and kidnapping. He was taken into custody and questioned about these crimes for over a two-hour period. Even though a signed confession was established and admitted as evidence at trial by the officers; this was a clear abuse of police power. Ernesto Miranda™s defense counsel objected to this action and was denied. He was later found guilty. The police even admitted to denying Mr. Miranda his right to have an attorney represent him while being interrogated. The verdict was appealed and taken to the state Supreme Court.
