FMLA v. ERISA
An employment relationship is a legal bond that brings together an employee and an employer with clearly defined rights and obligations for each party. It is worth noting that the existence of employment relationships between employers and employees across the world today is characterized by advanced dynamism and complexity such that there must exist clear legislation frameworks to serve as guiding principles for the relationship (ILO, 2018). In the absence of such guiding frameworks, the relationships between the employees would be significantly hard to manage as every party would be striving to create the best for themselves without any concern for the plight of the other. As such, the employment relationships in the United States of America are guided by various sets of legislation, including the Family and Medical Leave Act (FMLA) and the Employee Retirement Income Security Act (ERISA) of 1974. The FMLA is a legal entitlement for all eligible employees under covered employers to go for unpaid leave with a guarantee for job protection due to specific familial and health justifications and continue enjoying group health insurance services just like they were still at work.
