What is specific performance? Specific performance is a remedy to a contract dispute where one party must perform an act promised. Specific performance is used for unique goods, such as paintings, sculptures, rare books, and coins. It is also used in the sale of land. It's not used for common things because monetary damages can provide a sufficient remedy. This is because monetary damages cannot solve a dispute over rare items or one-of-a-kind items. Finally, specific performance is almost never granted for personal service contracts because it would amount to involuntary servitude (Miller & Jentz, 2008).
