In this case, police were preparing to execute a warrant at a residence and search the basement for a handgun (Bailey v. United States, 2013). While running surveillance on the residence, police noticed two men leaving the gated area in an unmarked car parked outside of the residence (Bailey v. United States, 2013). The two men, later identified as Chunon Bailey and Bryant Middleton, were pulled over approximately one mile from the residence and were detained by officers (Bailey v. United States, 2013). A patdown search was conducted on Bailey, œwho initially said that he resided in the apartment, but later denied it when informed of the search, and keys were found in his pocket (Bailey v. United States, 2013). Both men were handcuffed and driven back to the apartment where a team of officers had already found the gun in question along with illicit drugs (Bailey v. United States, 2013). After arresting the men, police officers found that one of the keys belonging to Bailey unlocked the door to the apartment. Bailey was then charged with œpossession of cocaine with intent to distribute, possession of a firearm by a felon, and possession of a firearm in furtherance of drug-trafficking offense (Bailey v.
